This means that the governing law for any dispute is in Switzerland, within the jurisdiction of the Canton Vaud.

Software provided “as is” and is delivered under the GPL-3.0 license beyond which there is no warranty.

By using the kiwix.org website and its related features, including the Imager Service and Kiwix Hotspot OS (the “Services”) and other services provided by Kiwix, you agree to be bound by the following terms of service (the “Terms”). These Terms cover all present and future features provided by Kiwix. The Services are operated by Association Kiwix. Use of our website or applications, or making use of our online services. By using these Services, you are agreeing to be bound by these Terms every time you use these Services.

The Services are provided exclusively to persons or legal entities. Accounts registered by “bots” or automated methods are not authorised and will be terminated. Each user is solely responsible for all actions performed through the Services.

If you agree to these Terms on behalf of a company or another legal entity, you represent that you have the authority to bind such entity, its affiliates, and all users who access the Services through your Account to these Terms. In the absence of such an authority, you are not authorised to use the Services.

Kiwix reserves the right to delete inactive imager accounts that are older than 12 months.

Kiwix does not make any warranty about the reliability of the Services or the security of user data, despite best efforts. Any Service is provided “as is” and “as available,” without warranty of any kind, either express or implied.

The total liability of Kiwix for any reason whatsoever arising out of or related to the use of, or inability to use, any Service provided by it, shall not exceed the amount you paid us, if any.

All trademarks, service marks, logos, trade names, and other proprietary designations of Kiwix displayed on this website are trademarks or registered trademarks. Nothing in these Terms of Service should be construed as granting, by implication or otherwise, any license or right to use any of the Kiwix Trademarks without our prior written permission in each instance.

Kiwix is a platform for sharing existing content and cannot be held liable for what other websites have published, including the accuracy of content. All is shared according to the source license.

We assign spending based on needs and only for the purpose of furthering our mission of providing free educational content, as defined in our statutes. Donations are non-refundable. If you need a receipt (for instance for tax purposes), please send an email to hello@kiwix.org indicating the full name and email address you used when making your donation(s). See our Privacy policy to know more about how our donations processors will handle your data.

You agree that these Terms shall be governed in all respects by the substantive laws of Switzerland and any dispute shall be subject to the jurisdiction of the competent courts of the Canton of Vaud.
